TERMS AND CONDITIONS FOR TUITION AT TECHNICS MUSIC ACADEMY

 

The following Terms and Conditions apply to all lesson agreements made between Technics Music Academy (“TMA”) and its pupils and the parents / carers of its pupils (“the pupil”)

 

  1. Term Dates

 

1a. Terms at TMA roughly adhere to the New Zealand Ministry of Education School Terms. However, there are occasional differences and our term dates are available on our website.

 

1b. At all times it is the responsibility of the pupil to be aware of the first and last dates of term at TMA.

 

1c. It is generally expected that lessons will NOT continue throughout the school holidays unless prior arrangements have been made.

 

  1. Communications

 

2a. All correspondence is sent out to the pupil by email. If this causes a problem, please let TMA know.

 

2b. It is the responsibility of the pupil to make TMA aware of any changes to their contact details. TMA will not be held responsible for any missed communications, late/overdue payments, missed lessons, etc. if this is due to incorrect contact information.

 

  1. Timetabling of Lessons

 

3a. The pupil will be informed of the lesson day, time and the date of their first lesson before teaching commences, either by phone, in person or by email. TMA will aim to confirm all the lesson details by email, but does not guarantee that this will be the case if it deems sufficient confirmation has been provided by other means.

 

3b. Site-based lessons – if the agreed lesson times or days need to be changed, the pupil will be contacted as far in advance as possible and alternative arrangements will be made to continue the lessons at times and days suitable to the pupil and TMA.

 

  1. Absences

 

4a. Individual lessons –

 

4.a.i. If the pupil is unable attend a lesson please let TMA know at the earliest time possible, either by email or telephone (contact details can be found online). Emails and messages left will be passed on to the relevant tutor(s) – there is no need to make direct contact.

 

4.a.ii. Pupils missing lessons due to sickness are required to notify TMA by no later than 10am on the day of their lesson to qualify for a catch up lesson. Pupils missing lessons for any other reason are required to provide a minimum of 72 hours notice to qualify for a catch up lesson.

 

4.a.iii. TMA will arrange a catch-up lesson for up to two lessons per term, where a pupil is unable to make a scheduled lesson and has given the required notice for the intended absence. Catch-up lessons must be completed within the two weeks immediately following the absence at one of the times specified by the tutor at the start of the term for catch up lessons. Lessons unable to be caught up during this period will be counted as missed and no refunds or credits will be given.

 

4b. Group and Pair lessons –

 

4.b.i. No catch-up lessons or credits will be provided for an individual’s absence from a group lesson/pair lesson.

 

4.b.ii. Where the entire group or pair is absent and 24-hours notice of this absence has been received, a catch-up lesson or credit may be arranged at the discretion of TMA Management.

 

4c. Tutor Absences –

 

4.c.i. If the pupil’s tutor is unavailable to teach, TMA will attempt to arrange a cover tutor.

 

4.c.ii. If this is not possible, the pupil’s normal tutor will reschedule the lesson. If an appropriate time is not able to be found, a lesson credit will be applied to the student’s invoice for the following term.

 

4d. Unavoidable cancellations –

 

4.d.i. If TMA cancels any lessons due to events out of its control (earthquake/flooding/snow etc.) a refund or credit may be given at the discretion of TMA management.

 

4.d.ii. If a school cancels TMA’s teaching due to events out of TMA’s control (sports days/school trips/etc.) catch up lessons / credits will only be made to the pupil if the school or pupil has given TMA at least three days’ notice that there is going to be such an event. It is not TMA’s responsibility to make itself aware of any such event.

 

4e. Ongoing absences –

 

4.e.i. If a pupil will be absent for more than two weeks due to medical reasons, a credit or refund may be given, at the discretion of TMA management.

 

  1. Re-enrolment

 

5a. The lesson agreement between TMA and the pupil is a rolling agreement that is ongoing from one term to the next.

 

5b. The pupil will be emailed an invoice at the start of each term for that term’s lessons, until a cancellation notice is received, as discussed below.

 

  1. Cancelling the Lesson Agreement

 

6a. If the pupil wishes to cancel the lesson agreement with TMA, written notice must be received by TMA Management within the first two weeks of lessons and the term fees from Week 3 onwards will be credited to their account or refunded. From the third week of lessons it is understood that the pupil has committed to the term and no refund will be provided should the pupil wish to discontinue during this time.

 

6b. Verbal notice given to the tutor will not be acted upon unless confirmed in writing to TMA by the pupil.

 

6c. If the pupil does not give written notice of their intention to discontinue lessons before the

commencement of the following term they may be charged a cancellation fee. Pupils on an annual rate will be charged a cancellation fee which will include the difference for lessons already received at the casual rate.

 

6d. Exceptions on medical grounds may be made to this as decided by TMA Management.

 

6e. If TMA has to cancel a lesson agreement it will endeavour to give two weeks’ notice to the pupil. Any lessons remaining after the lessons’ end date will be credited to the pupil’s account and refunded if payment has already been made.

 

6f. If, in exceptional circumstances, TMA has to cancel the pupil’s lesson due to damage of TMA

property or harassment of TMA staff by the pupil, this may be done with no notice and no credit or refund for any outstanding lessons.

 

  1. Fees

 

7a. The pupil will be billed for each term in full at the commencement of the new term.

 

7b. Accounts must be paid by the due date. An administration fee may be applied for any overdue amount.

 

7c. A discount of 10% will be applied to all lessons when three or more lessons / activities are attached to a single family record on the TMA database. This discount will not be applied retrospectively for any lessons already billed.

 

  1. Student Safety and Care

 

8a All Students must be supervised by their parents or a guardian before and after the lesson.

T.M.A. has no responsibility for any accident or problem with unsupervised students.

 

  1. Changes to the Terms and Conditions

 

9a. The Terms and Conditions described above may be changed at any point by TMA without

providing notice to the pupil. An up-to-date copy of the Terms and Conditions will always be available on our website and may be emailed to the pupil on request.
